AGREEMENT OF RELEASE AND WAIVER OF LIABILITY

Please read carefully and discuss questions or concerns with the instructor BEFORE checking the box below labeled "I Agree," which will constitute you signature and agreement to all terms and conditions.

1. I understand there are risks involved with yoga and meditation.

Risks. I understand that I am participating in yoga, meditation classes and instruction offered by Evolutionary Education, LLC. I recognize that yoga may require physical and mental exertion that can be strenuous, and I am fully aware of the risks and hazards involved. I understand that yoga and meditation programs may release strong emotions and I accept this possibility and the result of such emotional release.

Negligence. I acknowledge that there are risks and dangers that cannot be eliminated in this work, and even if a risk or danger could have been eliminated, this does not always occur.

Physical Contact. I understand and accept that in order to teach yoga and meditation, and to respond to the possible results of emotional release, physical contact between student and instructor may be necessary. I consent to such contact as is considered necessary by the instructor.

2. I am well enough to participate.

Physical Fitness and Medical Treatment. I understand that it is my responsibility to consult with a physician before participating in yoga, meditation and programs facilitated by Evolutionary Education, LLC. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in yoga, meditation and programs facilitated by Evolutionary Education, LLC. I will advise Evolutionary Education, LLC instructors of any and all physical and emotional conditions that could be affected by yoga, meditation, and Evolutionary Education, LLC offerings.

Personal Monitoring. I agree to follow instructions carefully. I further understand that I am responsible to monitor my body and to immediately stop any activity that causes me any unacceptable discomfort, emotional distress or pain, and I will report this to the instructor during and at the end of the program.

3. I accept these risks. I acknowledge that I am solely responsible for my welfare.

Assume Risk. In consideration of being permitted to participate in yoga and meditation programs offered through Evolutionary Education, LLC, I agree to assume full responsibility for all risks, injuries or damages, known or unknown that I might incur as a result of participating in such activities.

Deep Relaxation. I understand that yoga and meditation may produce a deep state of relaxation that can continue for many hours after the program is complete. I acknowledge that I may need to refrain from driving a vehicle after a yoga or meditation session, until I feel capable of responding to the situations that may arise while driving a vehicle.

4. Filming and recording during classes, trainings and retreats.

I acknowledge that during my participation in this event I may be filmed and/or recorded and my image and/or voice may appear in one or more videos or recordings, being produced by Nick Atlas or Evolutionary Education, LLC. I further acknowledge that one or more of the videos and/or recordings in which my image and/or voice appears may be posted to the Evolutionary Education, LLC website and may be shown at various Evolutionary Education, LLC events to support the initiatives of Evolutionary Education, LLC. I consent to Evolutionary Education, LLC posting the videos and/or recordings, which contain my image and/or voice, on its website or using the videos and/or recordings at retreats, workshops, classes, trainings and other events where they may feel it is appropriate to promote Evolutionary Education, LLC or for any other purpose. I am aware that the videos and/or recordings may be shared with and/or sold to various people with the Evolutionary Education, LLC organization with other people who are not part of the Evolutionary Education, LLC organization for the purpose of soliciting donations for Evolutionary Education, LLC and for other purposes and I consent to such use of my image and voice in these videos and recordings.

5. I waive my claim against the instructor and all other parties.

I release the instructor, substitute instructors, assistants, facility, Evolutionary Education, LLC and its directors, officers, advisors and employees (referred to as “Providers”) from all actions, causes, claims, suits, damages, and liabilities arising out of, or connected with, my participation in yoga, meditation and Evolutionary Education, LLC programs including, but not limited to, personal physical, mental or emotional injury, illness (including death) and/or loss of property. I agree to indemnify and hold harmless all of the Providers.

6. No other person(s) or party may make a claim.

I, my heirs, assigns, legal representatives and spouse, if any, forever release, waive, discharge and agree not to sue any of the Providers for any injuries or damages caused by their negligence.

7. I waive my rights to claims that are presently unknown or unsuspected.

I waive and release any right I may have under the laws of the state or country in which programs have been provided that extend to claims in which the student does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her, must have materially affected his or her settlement with the Providers.

8. Broad Waiver

I agree that this waiver will be interpreted, as broadly as allowed by law, and that if part of this waiver is deemed invalid then the balance shall remain in effect.

9. I am waiving rights that could otherwise have benefitted others or me.

10. I had time to, and did ask all questions I had about this waiver.

11. I have carefully read the above release and waiver of liability and fully understand its contents.

I freely and voluntarily agree to these terms and conditions even though I would not be able to participate without checking the box below labeled "I Agree," which constitutes my signature and agreement to all terms and conditions included in this waiver. I assert that my participation and signing is voluntary and that I assume all risks.
