By participating in Memphis Margarita Festival you acknowledge having read the statement below, understand its meaning and legal implications, and agree to the terms and stipulations here set forth. In consideration of attending Memphis Margarita Festival, I understand, acknowledge and agree to the following:

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Contemporary Media Inc. (The Producers) have put in place preventative measures to reduce the spread of COVID-19; however, the Producers cannot guarantee that you or anyone will not become infected with COVID-19. Further, attending could increase your risk of contracting COVID-19.

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending the Memphis Margarita Festival and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

I understand that the risk of becoming exposed to or infected by COVID-19 at the Memphis Margarita Festivals may result from the actions, omissions, or negligence of myself and others, including, but not limited to, artists, attendees, workers, and volunteers. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my associates may experience or incur in connection with my attendance at Memphis Margarita Festival or participation in Memphis Margarita Festival programming (“Claims”). On my behalf, and on behalf of my associates, I hereby release, covenant not to sue, discharge, and hold harmless the Producers, its employees, agents, artists and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Producers, Artists, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Memphis Margarita Festival program.

I agree to comply with any and all rules, regulations, terms and conditions of Memphis Margarita Festivals, including but not limited to those set forth in this document.

I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK OF PROPERTY LOSS, PERSONAL INJURY, SERIOUS INJURY OR DEATH, WHICH MAY OCCUR BY BEING A PART OF MEMPHIS MARGARITA FESTIVAL AND HEREBY FOREVER RELEASE, DISCHARGE AND HOLD THEPROJECT ORGANIZERS HARMLESS FROM ANY CLAIM ARISING FROM SUCH RISK EVEN IF ARISING FROM THE NEGLIGENCE OF THE PROJECT ORGANIZERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS OR REPRESENTATIVES, OR BY THIRD PARTIES, AND I ASSUME FULL RESPONSIBILITIES AND LIABILITY FOR MY PARTICIPATION.

I ACKNOWLEDGE THAT I HAVE READ THIS WAIVER RELEASE OF LIABILITY AND I FULLY UNDERSTAND ITS TERMS, AND I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS, AND I DO SO KNOWINGLY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR DURESS.
